Where a trust becomes (or may become) embroiled in a divorce, delicate issues can arise both for the trustees and for the divorcing spouses. This is all the more true when the trust in question is not governed by English law. Trustees are likely to need specialist advice at the earliest stage, and divorcing spouses will require guidance on how trust assets should be treated.
