The past 12 months saw many important developments for IP law. In trade marks these included L'Oreal (unfair advantage), Deere & Co (colour marks), Firecraft (invalidity/passing off) and Google AdWords. Image rights hit the headlines (Woody Allen and Michael Jackson), copyright law was tested by Stormtrooper helmets (Lucas Films), employees took confidential information/databases (First Conferences) and Virgin Atlantic successfully used and protected its patents for flat-bed seats, so IP practitioners have much to think about. We report on the issues and implications, and what the future holds for businesses and IP.
